Boyd and Naomi Boyd,” 840 South Garrison Street, which said stock certificates represent, inter alia, the shareholder’s interests in all property of the Agricultural Ditch and Reservoir Company (“Company”), including, but not limited to, the water rights owned, controlled or administered by the Company, together with all right, title and interest in the structures used for delivery of water and structures associated with the ownership of shares and water rights in the Company, including, but not limited to, all ditches, ditch rights, laterals, lateral rights, contract rights, water storage and release structures, easements, rights-of-way, headgates, flumes, irrigation structures, and related structures. If service of the Summons and Complaint was made upon you within the State of Colorado, you are required to file your Answer or other response within 20 days after such service upon you. By this action the Plaintiff is demanding relief in the form of a judgment declaring that (i) the property that is the subject of this action (i.e., an “E-Grass” pyrolysis system known as the Discrete Process Development Unit, or “PDU”) has been abandoned pursuant to C.R.S. § 38-20-116(1) and common law, (ii) Plaintiff has satisfied the requirements of C.R.S. § 38-20-116(2) and is entitled to sole ownership and possession of the PDU with the resulting rights to sell or otherwise dispose of the PDU immediately, as Plaintiff may see fit, without liability to any other person who may claim an interest in the PDU or any portion of it, (iii) Plaintiff is the sole owner of the PDU and holds legal and equitable title to it free and clear of any claims, liens or encumbrances of any other person who may claim an interest in the PDU or any portion of it; and (iv) for such other and further relief as the Court deems just.
