ORDINANCE NO. 1915
AN ORDINANCE OF THE CITY OF GOLDEN AMENDING SECTION 4.90.060 OF THE GOLDEN MUNICIPAL CODE PERTAINING TO REQUIREMENTS FOR PUBLIC SIDEWALK SALES AND DISPLAY PERMITS
WHEREAS, Chapter 4.90 of the Municipal Code details the procedures and requirements for public sidewalk sales and display permits, used to allow outdoor seating permits on City sidewalks; and
WHEREAS, Section 4.90.060 contains a limitation related to serving alcoholic beverages that is more restrictive than state and local liquor codes; and
WHEREAS, City Council desires to amend Section 4.90.060 to authorize the City to consider serving alcoholic beverages in seating areas that do not physically abut the associated business.
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GOLDEN, COLORADO:
Section 1. Section 4.90.060 (Requirements and conditions), is hereby amended by the repeal and reenactment of subsection (b) as follows:
(b) If a permit is requested for an area that is not immediately adjacent to a business associated with sale of the food and beverages, the issuance of the permit shall include the right to transport the food and beverages over the right-of-way to the permitted area where sales, service and consumption are allowed, provided that such transport does not involve traversing an area where motorized traffic is allowed and can be accomplished without unreasonably interfering with the flow of pedestrian traffic.
Section 2 All other ordinances or portions thereof inconsistent or conflicting with this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict.
Section 3 The repeal or modification of any provision of the Municipal Code of the City of Golden by this ordinance shall not release, extinguish, alter, modify or change in whole or in part any penalty, forfeiture or liability, either civil or criminal, which shall have been incurred under such provision. Each provision shall be treated and held as still remaining in force for the purpose of sustaining any and all proper actions, suits, proceedings and prosecutions for enforcement of the penalty, forfeiture or liability, as well as for the purpose of sustaining any judgment, decree or order which can or may be rendered, entered or made in such actions, suits, proceedings or prosecutions.
Section 4 This ordinance is deemed necessary for the protection of health, welfare and safety of the community.
Section 5 The repeal or modification of any provision of the Municipal Code of the City of Golden by this ordinance shall not release, extinguish, alter, modify or change in whole or in part any penalty, forfeiture or liability, either civil or criminal, which shall have been incurred under such provision. Each provision shall be treated and held as still remaining in force for the purpose of sustaining any and all proper actions, suits, proceedings and prosecutions for enforcement of the penalty, forfeiture or liability, as well as for the purpose of sustaining any judgment, decree or order which can or may be rendered, entered or made in such actions, suits, proceedings or prosecutions.

ORDINANCE NO. 1916
AN ORDINANCE OF THE CITY OF GOLDEN AMENDING SECTION 18.40.222 OF THE GOLDEN MUNICIPAL CODE PERTAINING TO LANDSCAPE PLAN REQUIREMENTS FOR COMMERCIAL AND MULTIFAMILY PROPERTY
WHEREAS, in 2001, the Colorado Legislature enacted the “Landscape Architects Professional Licensing Act” (the “Act”); and
WHEREAS, the Act specifies that beginning in January 2008, landscape design services (except residential landscape design for single-household residential and certain limited multi-family residential properties of four or fewer units) must be performed, and landscape plans must be stamped by a licensed landscape architect; and
WHEREAS, City Council desires to remove an inconsistency between City codes and state statutes.
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GOLDEN, COLORADO:
Section 1. Section 18.40.222 (Landscaping Standards) is hereby amended by the enactment of a new subsection (5) as follows:
(5) The final landscape plan for commercial and mixed use and multi-family residential projects shall be prepared and stamped by a Colorado licensed landscape architect.
